Terms & Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your use of the website and services provided by OCANIA SDN. BHD., a company registered in Malaysia with its principal office at 79 Lebuh Berangan, Kawasan 13, 42000 Pelabuhan Klang, Selangor. By accessing our website at www.ocaniamovers.com or engaging any of our services, you agree to be bound by these Terms in full. If you do not agree with any part of these Terms, please do not use our website or services.

2. Definitions

  • "OCANIA" / "We" / "Us" — refers to OCANIA Sdn. Bhd., its employees, agents, and authorised representatives.
  • "Customer" / "You" — refers to any individual or organisation that engages OCANIA's services or uses our website.
  • "Goods" — refers to all items entrusted to OCANIA for shipping, including but not limited to vehicles, cargo, heavy machinery, boats, yachts, and any other items shipped.
  • "Services" — refers to all shipping, towing, logistics, moving, and related services offered by OCANIA, including vehicle shipping, cargo shipping, heavy machinery shipping, boat and yacht shipping, tow truck service, Sarawak shipping, and house or office moving.

3. Booking & Payment

  • A booking is considered confirmed only upon receipt of the required deposit or full payment, as specified at the time of quotation.
  • Quoted prices are subject to change based on the actual weight, dimensions, and destination of the goods. Any adjustments will be communicated to the customer before shipment.
  • Payment shall be made via bank transfer or any other payment method mutually agreed upon between OCANIA and the customer.
  • Cancellation of a confirmed booking is subject to the cancellation policy outlined in Section 9 of these Terms.

4. Customer Responsibilities

As a customer, you agree to the following obligations:

  • Provide accurate and complete information about the goods to be shipped, including type, weight, dimensions, and condition.
  • Ensure that any vehicle to be shipped via RORO (Roll-On Roll-Off) is in drivable condition at the time of handover.
  • Remove all valuable personal belongings from vehicles prior to shipment. OCANIA is not responsible for any personal items left inside vehicles.
  • Provide all required documents, including but not limited to vehicle registration card (grant), a copy of identity card (IC), and a letter of authorisation where applicable.
  • Be present or arrange for an authorised representative to be present at the agreed time and location for both pickup and delivery of goods.

5. OCANIA Responsibilities

OCANIA is committed to providing professional and reliable services. Our responsibilities include:

  • Handling all shipments professionally and with reasonable care throughout the transportation process.
  • Keeping customers informed of the status of their shipments in a timely manner.
  • Providing all necessary shipping documentation required for customs clearance and delivery.
  • Taking reasonable measures to protect goods from damage during transit, loading, and unloading.

6. Limitation of Liability

OCANIA shall not be held liable under the following circumstances:

  • Loss, damage, or delay caused by force majeure events, including but not limited to natural disasters, storms, floods, war, civil unrest, epidemics, or pandemics.
  • Delays arising from adverse weather conditions, vessel breakdown or mechanical failure, port congestion, or directives issued by government or maritime authorities.
  • Any liability exceeding the value of the goods as stated in the shipping invoice.
  • Pre-existing damage to goods that was present before the goods were received by OCANIA.
  • Loss of or damage to personal items left inside vehicles during shipping.

7. Insurance

  • Customers are strongly encouraged to obtain appropriate shipping insurance to cover the value of their goods during transit.
  • OCANIA can assist customers in arranging third-party marine insurance upon request. However, OCANIA acts solely as a facilitator and is not the insurer.
  • All insurance claims are subject to the terms, conditions, and exclusions of the respective insurance company.

8. Damage Claims

  • Any damage to goods must be reported to OCANIA in writing within 24 hours of delivery. Claims submitted after this period may not be entertained.
  • Photographic evidence of the damage is required and must be submitted together with the claim.
  • All claims will be investigated in accordance with OCANIA's internal procedures.
  • OCANIA reserves the right to repair, replace, or compensate for damaged goods at our sole discretion, subject to the findings of the investigation.

9. Cancellation & Refunds

The following cancellation and refund policy applies to all confirmed bookings:

  • More than 7 days before scheduled shipment — Full refund, minus a reasonable administrative processing fee.
  • 3 to 7 days before scheduled shipment — 50% refund of the total amount paid.
  • Less than 3 days before scheduled shipment — No refund will be issued.
  • OCANIA reserves the right to cancel a booking if the goods are found to be dangerous, illegal, prohibited, or materially different from what was declared by the customer. In such cases, no refund will be provided.

10. Intellectual Property

All content on www.ocaniamovers.com, including but not limited to text, images, graphics, logos, icons, videos, and software, is the exclusive property of OCANIA Sdn. Bhd. and is protected by applicable intellectual property laws. Reproduction, distribution, or use of any content without prior written consent from OCANIA is strictly prohibited.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising out of or in connection with these Terms or the use of OCANIA's services shall be referred to and resolved by the courts with jurisdiction in Selangor, Malaysia.

12. Changes to Terms

OCANIA reserves the right to update, modify, or amend these Terms from time to time without prior notice. Any changes will be effective immediately upon publication on our website. We encourage customers to review this page periodically to stay informed of any updates. Continued use of our website or services after changes have been posted constitutes acceptance of the revised Terms.
